Churchill’s Cabinets Ltd., t/a Radiator Cabinets Direct (The “Seller”)

1. Definitions
1.1.      “Buyer” means the person who agrees to buy the goods from the seller.
1.2.      “Conditions” means the terms and conditions of sale set out in this document.
1.3.      “Delivery date” means the date specified by the seller when the goods are to be delivered.
1.4       “Price” means the price for the goods including delivery.
1.5.      “Goods” means the products which the buyer agrees to buy from the seller.
1.6.      “Seller” means Churchill’s Cabinets Ltd., t/a Radiator Cabinets Direct

2. Conditions Applicable
2.1.      These conditions shall apply to all contracts for the sale of goods and services by the seller to the buyer.
2.2.      All orders for goods shall be deemed to be a contract by the buyer to purchase goods pursuant to these conditions.

3. The Price and Payment
3.1.      The price shall be the price confirmed on the online order form or by confirmation email if you have ordered by phone.

4. The Goods
4.1.      The quantity and description of goods shall be as ordered online or by phone. If ordered by phone, a confirmation email will be sent confirming the buyers’ order specification details.

5. Delivery of Goods
5.1.      The seller should manufacture and deliver the goods to the buyers delivery address within 4 to 8 weeks of the date of order, subject to manufacturing delays beyond its reasonable control. The buyer accepts that this contract does not infer that time is of the essence.
5.2       The seller regrets that it is unable to offer a timed delivery.
5.3.      All deliveries will take place during weekdays, Monday to Friday between 06:00am and 20:00hrs and excluding bank holidays, and the buyer agrees to accept delivery on that basis.
5.4.      The seller will not accept liability for consequential losses for delivery delays.
5.5       The buyer understands that each individual cabinet ordered will be delivered part assembled and packaged and is to be assembled and installed by the Buyer.

6. Claims for defects, damages, loss or non delivery
6.1.      The seller believes that the goods and services supplied under this contract will be in full compliance of the agreed requirements and specification. However where the buyer believes the goods or services do not comply with the order placed, within 7 days, the buyer must immediately notify the seller, giving full details of their concerns..

The buyer must then arrange for the return of the goods to the seller by courier. If the seller agrees that the goods have not been made to the buyers’ exact specification, the buyer will refund the cost of the courier.
If, however, the goods are found not to be in breach of the contract, the buyer must bear the full cost of the return of the goods.
In the case where the buyers’ rejection of the goods is valid, the seller will then fulfil the order to the buyer’s original specification by supplying a replacement product within 4 to 8 weeks.
6.2.      Nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of the seller or effect the Statutory rights of a buyer dealing as a consumer.
6.3.      The seller will not consider any claim of consequential loss or expense.

7. Guarantee
7.1.      The goods are guaranteed for 12 months from the date of delivery.

8. Cancellation
8.1.      All of our radiator cabinets are made to measure using the Buyer’s measurements and are classed as personalised products and therefore are not refundable.

9. Consumer Rights
As a consumer you have certain statutory rights which may be relied upon in the event of a breach of contract or of the Sale of Goods Act or the Supply of Goods and Services Act. For more information about your statutory rights contact your Citizens Advice Bureau or Trading Standards Department.
